Please read your vacation rental agreement carefully before you begin your vacation.
Any monies received by Skis and Seas for occupancy of vacation property indicated the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.
A completed Vacation Rental Agreement is required to gain access to the condo.  To verify the name on the reservation, please send us a picture or copy of your driver's license. Please text to 850-399-0316.
The review and acceptance of Skis and Seas Vacation Rental & Conditions which is made part of this rental agreement is required before we give access to the condo.  Failure to send the completed "Vacation Rental Agreement" back with a valid driver's license will result in denial of access to the condo and forfeiture of amounts paid. 

 


Payment Policy
25% of the reservation total is due at the time of initial booking, final payment is automatically charged 35 days prior to arrival date and must be paid in entirety at this time. Guest staying 29 days or more, the balance is due 60 days prior to arrival.   All payments are nonrefundable, non-transferable, and non-redeemable. Visa, MasterCard, Discover and checks are all acceptable forms of payment. In cases of payment by check, all funds shall be made payable to Skis and Seas Vacation Rentals, with a notation of your confirmation number written on your check. A $35.00 service charge will be incurred for any returned checks. Reservations that are not paid in full by the final payment date will be cancelled and advance payment forfeited. If you need to split up a payment between cards, we charge $25 per transaction.
In lieu of payment of a Security Deposit, Guests shall supply a major credit card to be charged the cost of repair or replacement of items or other damage to the Rental Property caused by Guests or their invitees beyond ordinary wear and tear. As the Guest, you agree to reimburse the Owner for any damage to the Rental Property caused by you, your invitees, or others. Damages shall include reasonable attorney’s fees and court costs incurred by Owner and Skis and Seas Vacation Rentals, LLC as their Agent in enforcing this section.

Cancellation Policy
If an advance rental payment is not received in full to Skis and Seas Vacation Rentals by the due date stated in the payment policy, the reservation will be considered canceled without refund. Written notice is required to cancel your reservation. Standard policy: all payments are non-refundable, nonredeemable, and non-transferable.  Early departure/ late arrival does not warrant any refunds.
We encourage the purchase of travel insurance to protect your investment in situations where a member of your party is sick or injured, preventing them from traveling. Power/ Weather/ Epidemic Related Cancellation
Skis and Seas Vacation Rentals does NOT issue refunds due to acts of nature such as: weather, road conditions, snow conditions, power outages, virus, delay/cancelation of flights, mountain closures, or forest fires, but Travel Protection Insurance does provide some protection against these instances. There will be NO REFUNDS OR CREDITS FOR EMERGENCY EVACUATIONS, OR ANY TRAVEL RESTRICTIONS. Should a hurricane or tropical storm threaten our area we will receive evacuation instructions from the National Hurricane Center and our local governing officials. If the Mandatory Evacuation order is given, refunds will be issued by RentalGuardian.com and InsureStays if you have purchased coverage before the storm was named and if it meets their criteria. Skis and Seas Vacation Rentals will not issue refund of any rent payments.  There will be no refunds of any kind for evacuations. or anything Covid related. 

 

Changes to Reservation
Once the reservation is made, we do not allow changing dates. 

Trip Insurance
Payments to Skis and Seas Vacation Rentals are non-refundable, non-transferable, and non-redeemable, as described above under Cancellations. Trip insurance is highly recommended to protect your vacation. Trip Insurance must be purchased at time of booking. Skis and Seas Vacation Rentals partners with a third-party trip insurance company. All claims made to the trip insurance company are up to the discretion and ultimate decision of the travel insurance company. Additional documentation to the trip insurance company may be needed and should be submitted to the trip insurance company directly by the guest. Purchase Travel Protection at booking or on or before final payment, and at least 30 days prior to arrival, for coverage of over 30 reasons for trip cancellation or interruption. Purchase Travel Protection with Cancel For Any Reason at booking or within 14 days of booking, and at least 30 days prior to arrival, for 100% coverage for 30 reasons plus 60% coverage for cancellations due to any other reason.

Accidental Damage Protection
Accidental Damage Protection is a mandatory, nonrefundable charge on each rental reservation and covers you and your family up to $1200 for any accidental damage during your stay. Damage Protection is not an insurance policy and nothing in this agreement shall be construed to constitute a contract of insurance. Damage Protection does NOT cover intentional damage, theft, Acts of God, gross negligence, or loss of use. Any accidental damage must be reported You MUST report all damaged and/or broken items to marcella@skisandseas.com ASAP.  You must report the accidental damage through email with picture prior to check out time  or it is not covered under the damage protection  When you report a damage you will always get a confirmation back. The Guest agrees to reimburse the Owner for any damages to the property caused by Guest that exceeds, or is not covered by Damage Protection or the security deposit.
Skis and Seas Vacation Rentals is hereby granted the right to charge the Guest's credit card. An itemized statement outlining all associated costs will be sent via regular or electronic mail to the address submitted by the Guest at such time as the reservation was booked. By written or electronic endorsement of this Agreement, the Guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.  Should a claim be filed in court, the guest signing this agreement will be responsible for all court fees and cost. 

Check In Time
Check in time is after 4:00 P.M. If the condo is ready prior to 4pm, an early check in may be arranged for $50/ hour. Sometimes, pending other reservations and housekeeping schedule, a guaranteed 2pm check in is available for $100.  Please contact us within 24 hours of your arrival to make these arrangements. Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your schedule check in time. Sometimes there are unforeseen circumstances that delay the check in time, but we will have the condo ready as soon as possible. No compensation will be given if the condo is not ready by 4pm. If you know that you will be arriving late, please let us know so we can schedule housekeeping accordingly. 

Check Out Time
Check out time is before or at 10:00 A.M. Your prompt departure is appreciated so we can prepare the condo for any incoming guests. A noon departure may be arranged for $100 pending other reservations and the housekeeping schedule. If you have not arranged for a late check out, you may be charged $50 for each hour beyond 10 am you are still on property, at a minimum of one hour. If the condo has not been vacated by 4 pm, a fee equal to the rental rate of 2 ½ days may be assessed plus the cost of relocating the next guest. 

Upon Arrival
Take a look around the condo. If there are concerns or issues with your rental property, please immediately contact our office (leave a message if there is no answer). Manager agrees to have it repaired as soon as possible. No compensation or credit will be given. 

Cleaning Requirements
 A non-refundable cleaning fee is required with all reservations. This fee is for our housekeepers who dust, vacuum, sanitize, clean linens and towels, and remove refuse from the property.  This property is self -catering and as such, each guest cleans their own pots/pans dishes, glasses, utensils, etc. Housekeeper sanitizes kitchen, bathrooms, appliances, surfaces and floors. She does not go through the contents of the kitchen.
Guest(s) are required to follow all check out procedures detailed in this agreement and leave the property in the same general and good habitable condition it was in when the Guest(s) arrived. Undue and/or unreasonable cleaning of the condo shall be charged to the Guest's/Cardholder's credit card as an Additional Cleaning Charge at a rate of up to $50/hour, with a one hour minimum. This also applies to the property exterior, grounds, BBQs and hot tubs (if so equipped). There is no daily housekeeping. You can add in a mid week clean if you want fresh towels and linens during your stay. 
 A starter supply of expendable supplies such as paper goods and soap is provided; please bring additional if you feel this will not be adequate.  Housekeeping is not provided during your stay unless previously arranged. Failure to comply with pre-departure cleaning requirements resulting in excessive cleaning will be charged to your credit card at $50/hour, with a one-hour minimum.

Check out Responsibilities 
Upon checkout, please leave the property in the same general condition as it was found. Departure responsibilities including the following: 
Place soiled towels in the bathtub., All dirty dishes, cookware and eating utensils should be placed in dishwasher and please start it. All household trash, garbage, recycling and/or other discarded items should be properly bagged up and discarded.. All wristbands/ fitness key and or tram passes need to be placed on counter. Missing items will be charged to credit card on file. ( Ariel Dunes: You must take a picture on check out date of the wristbands hanging on the hooks. Missing wristbands will be charged $25 a piece, Not providing a picture will result in a $50 charge plus cost any missing wristbands.
(The HOA set these ridiculous prices)   GLITTER AND CONFETTI ARE NOT ALLOWED AT ANY PROPERTY, INSIDE OR OUTSIDE. If you put up party decorations, please remove them including any tape on walls.
Failure to comply with these responsibilities may result in additional charges to the guest.

Rental Occupancy and Age Requirements
 For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the Guest. All other persons involved with the rental are considered to be the Guest's invitees, and all discussion regarding reservation, cancelation, and damage policies will be discussed with the Guest, not the Guest's invitees. The Guest understands that Skis and Seas Vacation Rentals rents to responsible adults over the age of 25 ONLY and that the guest that is the card/debit holder has to be present at all times. Guest(s) agrees that more than the number of people stated on the reservation shall not occupy the premises. Unauthorized people at the condo at any time will result in a double charge for each additional guest or a maximum occupancy charge (whichever is more), and loss of any security deposit, in addition to any and all damage, disturbance, and cleaning charges.  If Max occupancy is exceeded,  it will result in immediate eviction with forfeiture of all monies paid.  The rental is not intended for parties, nor gatherings at any time of anyone except those who have paid to occupy the property. Exceptions are made on an individual basis - please contact Skis and Seas Vacation Rentals for prior approval. If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premise without any refund and additional charges may be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the condo can be prepared appropriately for your group. Any breech of the above policies will result in termination of this agreement, including possible eviction of the property and forfeiture of any monies paid.

*The approval of this application at the stated rate is based on Adults {reservations.occupants} Children {reservations.occupants_small} .   If more than these guests below are added after this rental agreement is completed, the charge is $10 per person per day and has to be approved. We reserve the right to not approve additional guests.  Only the guests listed below are allowed in the unit. We do not allow visitors.  If maximum occupancy is reached, we cannot allow for additional guests.

Pet/ Smoking Policy
Sorry, no animals or pets are allowed in any property. Smoking is NOT permitted in any Skis and Seas Vacation Rental condo. Do not spit chewing tobacco on the balcony. Violations of this policy will result in a minimum  $500 fine and the damage waiver will be voided and tenant will be liable for any damages.

Linens & Towels
 Bath towels, sheets, pillows and blankets are provided. We do not provide any linens or towels for outdoor use. DO NOT take the condo linens or towels outside. Bring items with you that you may need for beach and pool. Many guests who plan on taking advantage of our full kitchen and laundry bring extra/ their own dish soap, garbage bags, dishwasher detergent, bar soap, paper towels, toilet tissue, laundry detergent/softener, shampoo, hair dryer and beach towels.  

Mail
Mail service to vacation rental properties can be unreliable. We do not provide access to the mailbox if the property has a mailbox. We recommend guest use either general delivery or a private carrier such as Fedex or UPS. Additionally, the manager cannot be held responsible for the timeliness or accuracy of any delivery. 

Property Rules
Hereby guest acknowledges that guest will not be entitled to any refund for any inoperable appliances, to include by way of example only, television, air conditioner, hot tub, pool or community amenity. The agent agrees that upon notification by guest of any malfunction Agent shall make every reasonable effort to have such appliance or item promptly repaired. If applicable, this agreement is subject to the approval, rules and regulations of the subject property Association, of which the owner is a member. Guest agrees to all Association rules and regulations, and to pay fees applicable for approval. If Association does not accept or approve guest, this agreement shall be cancelled, and all rental monies shall be refunded. 

Plumbing
 Do not put any feminine products in the toilet.  Plungers are provided if a clog occurs. If we need to send the handyman out to unclog, there will be a $75 charge.

TV & Internet
Cable TV is provided and service level has been chosen by the Landlord. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to cable TV service.
Wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.

Air Conditioner
Tenant agrees that Air conditioning shall not be set below 68 degrees and heat shall not be set above 78, and that the fan setting shall be “Auto”. Doors and windows shall be closed when either heat or air conditioning is in operation.  If it stops working and the cause is a frozen up air conditioner, the tenant will be charged for the service amount. 

Amenities
Community or condominium amenities, including the pools, wifi, etc  are not controlled or maintained by Skis and Seas Vacation Rentals; therefore, Skis and Seas Vacation Rentals cannot be held responsible for inconveniences resulting from these amenities.  No concessions will be provided for the lack of pool heat or pool, tennis closings, not working of any the amenities. Community Pool Heating is offered seasonally under the control of the managing associations. Dates may vary.

Left Items
Please check carefully for belongings before you leave. Left items can be mailed to you if requested and you will be charged shipping costs plus a $10 service fee. Skis and Seas Vacation Rentals is not responsible for lost or stolen items.

Right Of Entry
Guest(s) agree that Skis and Seas Vacation Rentals reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate, or to show the property to prospective purchasers or guests (in which case prior notification will be given). If you call for a service and send the person away, you will be charged $100. If you get evicted, you will forfeit all money paid plus are liable for all damages. 

Emergency/ Maintenance
In the event of a problem getting in the condo or if there are problems with condition or functionality of the condo, please immediately contact Skis and Seas Vacation Rentals  (leave a voice message and send a text message if there is no answer!) at (850) 399-0316. If it is after office hours we will make every effort to return your call as soon as possible. If we do not promptly return your call and it is an urgent situation, you may call Vacation Rental Maintenance at (850) 399-0120. Otherwise, you will be contacted during normal business hours. 

Security & Safety Risk
ALWAYS LOCK DOORS AND WINDOWS WHEN YOU LEAVE THE CONDOS! When you rent the condo, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the condo.
Indemnification & Hold Harmless
While Skis and Seas Vacation Rentals and its Property Owners strive to maintain Vacation Properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All Guest(s) and their invitees use the Vacation Property structures and premises at their own risk. Skis and Seas Vacation Rentals and its Property Owners shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and BBQs), electrical , furnishings, and/or other equipment, whether by malfunction, misuse, neglect,  acts of God/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the Vacation Properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the Vacation Property and/or its contents. Skis and Seas Vacation Rentals and its Property Owners shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the Vacation Property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this Agreement, Guest(s) and invitees hereby agree to forever hold-harmless and indemnify Skis and Seas Vacation Rentals and its Property Owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest(s) use of the property.

Assumption of the Risk and Waiver of Liability relating to Coronavirus/ Covid- 19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and the Center for Disease Control (CDC). COVID-19 is extremely contagious and is believed to spread mainly from person to person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Neither Skis and Seas Vacation Rentals (Rental Management), the Lessor, Owner,  nor the Association, can guarantee that tenant, its family, or guests will not become infected with COVID-19 while using the lease property and community amenities. Tenant acknowledges that Rental Management, Lessor and Association do not carry liability insurance providing coverage for contracting an infectious disease. Tenant also acknowledges the contagious nature of COVID-19 and voluntarily assumes the risk that tenant and all members of their party may be exposed to or infected by COVID-19 while using the leased property and community amenities and that such exposure or infection may result in personal injury, illness, permanent disability, and death. Tenant agrees to assume all of the foregoing risks and accept sole responsibility for any injury to itself, members of its party and guests (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind that we may experience or incur in connection with our use of the rented property and community amenities. Tenant hereby releases and covenant not to sue, discharges, and agrees to defend and hold harmless Rental Management, Lessor, Owner and Association, of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto to the contraction of the coronavirus infection or COVID-19. Tenant understands and agrees that this release includes any claims based on the actions, omissions, or negligence of the Rental Management, Lessor, Owner, Association, its employees, agents and representatives, whether a COVID-19 infection occurs before, during, or after the lease term. Tenant acknowledges the contractual assumption of the risk as set forth herein is a specific condition of Lessor agreeing to lease the property. Tenant acknowledges this is a specifically negotiated term and monetary amount of the lease is specifically based upon the inclusions of this provision.

Entire Agreement: This agreement contains the entire agreement of the parties. It may not be changed orally, but only by an agreement in writing signed by the party against who enforcement of any waiver, change, modification, extension, or discharge is sought. Guest cannot assign or transfer this Agreement.
